Delhi High Court Declares Refusing Marriage Over Kundali Mismatch After Physical Relationship a Crime

New Delhi, 25 Feb : The Delhi High Court has stated that refusing to marry a woman after starting a physical relationship, based on a horoscope (kundali) mismatch, can be considered a crime if the relationship involved repeated marriage promises.

This decision arose while the court was reviewing a bail application from a man accused of sexual assault. The court noted that the accused had engaged in a consensual physical relationship with the woman over time and had assured her that there would be no obstacles, including kundali compatibility, to their marriage.

However, the man later chose not to marry her, citing a mismatch in their horoscopes. The court found this change in his stance contradictory to his prior promises and noted that it raised questions about the sincerity of those promises. The court suggested that the woman's consent might have been swayed by the false assurance of marriage.

According to Section 69 of the Bharatiya Nyaya Sanhita (BNS), engaging in sexual intercourse through deceit or a false promise of marriage is a punishable crime. This provision can lead to a sentence of up to 10 years in prison, along with a fine.

While the court highlighted that not every failed relationship is a criminal matter, it clarified that if consent for a physical relationship is gained mainly through a misleading marriage promise, legal action may result. In this case, the court rejected the bail application, and further proceedings will continue.
