Gujarat Man to Re-Wed Wife in Traditional Ceremony to Resolve Custody Dispute
Ahmedabad, April 16 – In an unusual legal episode blending modern legality with traditional values, the Gujarat High Court has successfully mediated a marital conflict, concluding with the husband agreeing to remarry his wife in a customary ceremony to gain her family's acceptance.
The couple had legally registered their marriage in Ahmedabad on February 25 at the Dariapur marriage registrar’s office. Despite this, the union faced opposition from the bride’s family due to inter-caste differences. The disagreement escalated to the Vadaj police station, where a temporary resolution was reached, involving plans to conduct a traditional wedding ceremony on April 19 in the bride’s native village, Nandaliahara, in Rajasthan’s Dungarpur district.
Following the police-mediated agreement, the bride returned with her family, while the groom was to formally arrive in Rajasthan for the ceremonial nuptials. However, after receiving no communication from his wife, the husband petitioned the Gujarat High Court on April 14, seeking to be reunited with her.
Appearing before the court, the woman clarified that she was willingly staying with her parents and was open to returning to her husband, but only after a traditional wedding was conducted in her village. While the groom’s family expressed apprehension about their safety in Rajasthan, the bride’s family firmly insisted on the customary rites.
The matter was finally settled after the bride’s father gave an undertaking before the court, guaranteeing the safety and hospitality of the groom and his family during their stay in Dungarpur. Reassured, the petitioner’s family agreed to proceed with the traditional ceremony.
With mutual consent and security assurance in place, the High Court dismissed the petition, noting that the woman was not under any illegal confinement and that both families had agreed to recognize the couple as legally wedded after completing traditional rites.
