"Just Married" Isn't Enough: Why Your Green Card Could Be Denied

TST Report , 2 Jan : Marrying a US citizen has long been seen as a clear path to permanent residency, but a leading immigration attorney warns that a marriage certificate alone is no longer the golden ticket it once was. Under intensified scrutiny, couples who fail to prove they share a daily life—specifically a home—face a high risk of rejection.

Living Together is Non-Negotiable

According to US immigration attorney Brad Bernstein, the era of assuming a legal marriage guarantees a Green Card is over. In a recent warning, Bernstein highlighted that authorities under the current administration are doubling down on fraud detection. The biggest red flag? Spouses living at different addresses.

Bernstein was blunt in his assessment : "Being in a relationship does not get you a Green Card. Living together gets you a Green Card." He explained that immigration officials are increasingly dismissing excuses for separate living arrangements, whether they are due to employment, education, or financial constraints.

The "Bona Fide" Test

The core of the issue lies in proving a "bona fide" marriage. US Citizenship and Immigration Services (USCIS) officers are tasked with determining if a union is genuine or entered into solely for immigration benefits. When a couple does not share a residence, it immediately triggers suspicion.

"If you're not sharing a home every day, immigration authorities will begin questioning the legitimacy of the marriage," Bernstein stated. Once credibility is questioned, the application process often shifts to an investigation phase where officers actively look for grounds to deny the request.

For couples navigating the complex US immigration system in 2026, the message is clear: legal paperwork proves you are married, but a shared address proves you are building a life together. Without the latter, your application could be dead on arrival.
